What the South Dakota Law Says

Under South Dakota Codified Law § 34A-6-109, all detached catalytic converters are considered nonferrous metal property, and scrap metal dealers must record every sale — regardless of the purchase price.

Required records must include:

  • Seller’s full name, address, and signature
  • Date, location, and value of the transaction
  • Photocopy of the seller’s government-issued photo ID
  • Description and weight/volume of the converter
  • Name of the employee handling the sale

These records must be legible and available at the location of the transaction.

Additionally, SDCL § 32-15-17 enforces laws regarding exhaust systems. All vehicles must have working exhaust systems and mufflers — no illegal modifications (like muffler cut-outs) are permitted. This supports theft prevention by ensuring exhaust components remain intact and traceable.
