Selling Catalytic Converters in South Dakota

If you’re looking to sell a catalytic converter in South Dakota, it’s important to know the legal requirements. While South Dakota doesn’t have the strictest converter laws in the country, the state does require scrap metal businesses to keep detailed records — especially for detached converters.

What the South Dakota Law Says
Under South Dakota Codified Law § 34A-6-109, all detached catalytic converters are considered nonferrous metal property, and scrap metal dealers must record every sale — regardless of the purchase price.
Required records must include:
- Seller’s full name, address, and signature
- Date, location, and value of the transaction
- Photocopy of the seller’s government-issued photo ID
- Description and weight/volume of the converter
- Name of the employee handling the sale
These records must be legible and available at the location of the transaction.
Additionally, SDCL § 32-15-17 enforces laws regarding exhaust systems. All vehicles must have working exhaust systems and mufflers — no illegal modifications (like muffler cut-outs) are permitted. This supports theft prevention by ensuring exhaust components remain intact and traceable.
